NOTE:  THIS EVENT IS FILLED TO CAPACITY

This program will serve as a general introduction to the jurisdiction and jurisprudence of the CFC for law clerks, summer associates and interns, as well as young lawyers. A panel of judges and both government and private practitioners will conduct a “tour” of the court’s unique and varied substantive practice areas. The program is open to any and all students, interns, summer associates or young lawyers, and we ask that you spread the word about the program to all potentially-interested individuals in your organization. The program will be held in the Tayloe House and will start at 12:00 PM. This program is inaptly described as a “brown-bag” program, because lunch will be provided courtesy of the Bar Association.  To register, please send an email to sandy@cfcbar.org.

25th Judicial Conference on November 15 - Register Now!

You are cordially invited to attend the 25th Annual U.S. Court of Federal Claims Judicial Conference on Thursday, November 15, 2012.  The theme of this year's conference, "Growing Areas of Practice in the Court of Federal Claims," celebrates the court's 30 years of fulfilling its congressional mandate through its unique areas of practice.  The Conference and luncheon will be held in the National Courts Building, with a reception at the neighboring Decatur House to follow.

The Conference will kick off with a "Meet the Circuit Judges" panel featuring the Honorable S. Jay Plager, who will serve as the moderator and introduce the Circuit's newest judges:  Circuit Judges O'Malley, Reyna, and Wallach - to the Court of Federal Claims bench and bar.  The General Session will consist of panels of judges, leading Hill staff and practitioners with expertise in the important areas of the Court of Federal Claims' jurisdiction, with a special emphasis on tax, military pay, and contracts.  There will additionally be a panel to consider the ethical concerns raised by certain class and collective actions brought before the court in pay and Rails-to-Trails litigation.  A concurrent Vaccine Session will focus on hot topics before the Office of Special Masters, including implementation of proposed Table amendments following last year's release of the Institute of Medicine Report on Vaccine Safety and proposed changes to the Vaccine Practice Guidelines.  For further information and registration details, CLICK HERE.

Announcing the Carole Bailey Scholarship

Court Reporting Services

Please be aware that as of June 24, 2013, the Court of Federal Claims no longer has a reporting contract with Heritage Reporting. A new contract has not yet been awarded. In the interim, the court will use the GSA schedule for court reporting and transcription services. To request a transcript for post-June 24th court proceedings, contact the clerk's office at (202) 357-6414.

2013 Carole Bailey Scholarship Winner

The winner of the 2013 Carole Bailey Scholarship is Andrew Murray, a first year law student at Vanderbilt Law School. Before law school, Andrew worked for several years in the social services field and intends to become an advocate for marginalized people.

The bar association received a large number of applications, most of which were highly meritorious and deserving of substantial praise. The scholarship committee was very impressed by the commitment to public service exhibited by all the applicants and welcomes them to compete again next year as long as they have not completed their legal education.

Appointment of Judge Patricia Campbell-Smith and Designation of Chief Special Master Denise K. Vowell

Patricia E. Campbell-Smith took the oath of office on September 19, 2013, as Judge of the United States Court of Federal Claims. Judge Campbell-Smith was nominated by President Obama on March 19, 2013, confirmed by the Senate on September 17, 2013, and appointed by the President to a 15-year term on September 19, 2013. Chief Judge Emily C. Hewitt of the United States Court of Federal Claims (USCFC) announces the USCFC’s designation on September 19, 2013, of Special Master Denise K. Vowell to the position of Chief Special Master of the National Vaccine Injury Compensation Program (Vaccine Program), located within the USCFC by the National Childhood Vaccine Injury Act, codified at 42 U.S.C. §§ 300aa-1 to -34. Postponement of Judicial Conference and Annual Meeting/Election Scheduled for 10/17/2013

Due to the shutdown of the federal government, the United States Court of Federal Claims and the Court of Federal Claims Bar Association have decided to postpone the court’s 26th Annual Judicial Conference scheduled for October 17, 2013.  The conference will be rescheduled in early spring 2014.

Registration fees and sponsorships will be applied automatically to the new conference date.  Please visit http://www.uscfc.uscourts.gov/conferences/2013/ and http://cfcbar.org for more information once the government has reopened.

In addition, the bar association has decided to postpone the Annual Meeting/Election scheduled for October 17, 2013 at 5:00 p.m.  The annual meeting will be rescheduled once the government has reopened.  Please check back for further details.

Judicial Conference Rescheduled for 02/25/2014

Please save the date for the 26th Annual U.S. Court of Federal Claims Judicial Conference, now rescheduled for Tuesday, February 25, 2014. The Judicial Conference is being sponsored by the Court and the U.S. Court of Federal Claims Bar Association, in partnership with the Supreme Court Institute of Georgetown University Law Center. The half-day conference will begin at 1:00 p.m. and will be held in the National Courts Building at 717 Madison Place, NW, Washington, DC. The conference will be followed by an evening reception starting at 5:30 p.m. at the neighboring National Museum of Women in the Arts, at 1250 New York Avenue, NW, Washington, DC. In Memorium: Randolph Thrower (1914-2014)

Newly Admitted Lawyers' Division

Newly Admitted Lawyers' Division Inaugural Meeting/Reception on August 14

The Division will be hosting its inaugural event from 5pm to 7pm on Thursday, August 14, at Tayloe House (within the Court complex at 717 Madison). The event will be free, and will include beer, wine, and appetizers. Chief Judge Campbell-Smith, as well as Judges Wheeler and Kaplan, will speak on a panel concerning “Best Practices for Newly Admitted Lawyers Practicing Before the Court.” Mr. Schwartz will moderate the panel. After the panel speaks, there will be an informal meet-and-greet with the three judges.

Immediately preceding the event, at 4:00pm, there will be a meeting in Tayloe House for all interested members of the Division who are in good standing with the Bar Association. At this meeting, those in attendance will have an opportunity to vote on ratification of the Division’s recently drafted bylaws, copies of which will be distributed at the meeting.

Lydia K. Grigsby Took the Oath of Office on 12/15/14

Lydia Kay Griggsby took the oath of office on December 15, 2014, as Judge of the United States Court of Federal Claims. Judge Griggsby was nominated by President Obama on April 10, 2014, confirmed by the Senate on December 4, 2014, and appointed by the President to a 15-year term on December 5, 2014. The oath of office was administered by Chief Judge Patricia Campbell-Smith.

Notice of Proposed Amendment to the Rules

The following notice has been issued by the Court of Federal Claims:

Pursuant to 28 U.S.C. §§ 2071(b) and 2503(b), the United States Court of Federal Claims hereby provides notice that it proposes to amend its rules and invites public comment on the proposed amendments. The proposed amendments affect (i) RCFC 5.5, 40.1, 52.2, 77, 83.2, and 83.4; (ii) Vaccine Rules 2 and 11; (iii) Supplement to Appendix B ("Electronic Case Filing Procedure in Vaccine Act Cases"); (iv) Appendix E ("Electronic Case Filing Procedure"); and (v) Form 2 (cover sheet and nature-of-suit codes). All proposed changes are shown by strikethrough and yellow highlighting in the attached document. Comments must be received by June 22, 2015, and addressed to:

In Memoriam: Sr. Judge Francis Allegra

The bar association is sad to announce that our friend and colleague Senior Judge Francis Marion Allegra, of the United States Court of Federal Claims, died Thursday, August 27, 2015. Judge Allegra was appointed to the United States Court of Federal Claims by President William Clinton on October 22, 1998 where he served with great distinction. He took senior status in 2013, and retired on June 23, 2015.  Judge Allegra was a great friend and supporter of the bar association and will be greatly missed.  He is survived by his wife Regina and two sons Vinny and Domenic.

Judge Allegra was born in Cleveland, Ohio on October 14, 1957. He received his B.A. from Borromeo College of Ohio in 1978 and his J.D. from Cleveland State University in 1981. He clerked for Chief Trial Judge Philip R. Miller at the U.S. Court of Claims from 1981-1982, then worked as an associate at Squire, Sanders & Dempsey in Cleveland until 1984. He moved to the Tax Division of the Department of Justice serving in many capacities, and finally as Deputy Associate Attorney General from 1994-1998, when he was appointed to the bench.
