This panel ventures into lesser-known areas of the Court’s practice: judicial, military and civilian pay claims. The judicial pay panelists will discuss Beer v. United States, 696 F.3d 1174 (Fed. Cir. 2012) (en banc), which concerned Constitution-based judicial pay claims, and its aftermath. The military pay panelists will introduce listeners to the various types of military pay cases, including their substantive and unique procedural features. The civilian pay panelists will do the same regarding civilian pay cases, including the exploding area of Fair Labor Standards Act litigation.
